Kunj Lal R/O Matta Tehsil & District Kishtwar (now retired)(4) Sh. Abdul Qayoom the then Girdawar, Pouchal S/O Sh. Ghulam Rasool Sheikh R/O Haryal Chowk Kishtwar (now retired) And the accused private beneficiaries namely (5) Sh. Vinod Kumar S/O Sh. Anant Ram Parihar R/O Pouchal Tehsil & District Kishtwar,(6) Sh. Om Parkesh S/O Sh. Anant Ram Parihar R/O Pouchal Tehsil & District Kishtwar, (7) Sh. Sat Paul S/O Sh. Anant Ram Parihar R/O Pouchal Tehsil & District Kishtwar, (8) Shri Pardeep Singh S/O Naib Chand R/O Pouchal Tehsil & District Kishtwar, (9) Shri Dewan Chand S/O Shri Nath Ram R/O Pouchal Tehsil & District Kishtwar, (10) Shri Surinder Kumar S/O Anant Ram R/O Pouchal Tehsil & District Kishtwar and (11) Shri Kuljeet Singh S/O Sh. Anant Ram R/O Pouchal Tehsil & District Kishtwar before the Hon’ble Court of Special Judge Anti-Corruption Doda in case FIR No.03/2014 P/S VOJ 5(1) (d) r/w section 5(2) P.C. Act Svt. 2006 & sections 420, 467, 468, 471 and 120-B RPC. Brief facts of the case are that the instant case was registered in P/S VOJ on the basis of a verification conducted into the allegations made in the complaint lodged by Sh. Lal Chand S/O Sh. Anant Ram R/O Pouchal Tehsil & Distt. Kishtwar and another on 03.02.2011 alleging therein that land measuring 60 kanals and 16 marlas falling under Khasra No.2772/583 min which was shown in revenue records since 1971 as Government land not inhabited by anyone has been fraudulently mutated by the revenue authorities in the name of Pardeep Singh and others on monetary considerations. It was alleged that said land was coming within the alignment of the Kishtwar Chatroo Sinthan Road and involved huge amount of the compensation which prompted the above action by the revenue authorities who acted with malafide intentions to confer undue benefit upon Pardeep Singh and others in lieu of huge monetary benefits. The verification conducted has revealed that the said land was “Shamlat Deh” and the proprietary land owners of the village had proportionate share in the same but Shri Abdul Rashid Bhat the then Tehsildar, Kishtwar (now expired), Abdul Qayoom the then Girdawar, Halqa Pouchal (now retired)Shri Om Dutt then Patwari Halqa Pouchal (now retired) and Mohd Iqbal Kichloo then Patwari Halqa Pouchal entered into criminal conspiracy with the beneficiaries namely Shri Pardeep Singh S/o Naib Chand, Shri Dewan Chand S/o Nath Ram, Shri Om Parkash, Shri Sat Paul, Shri Surinder Kumar, Shri Vinod Kumar and Shri Kuljeet Singh, Sons. of Anant Ram residents of Pouchal and by abusing their official position made fraudulent entries in revenue record exclusively in their favour in respect of the portion of land falling under Kh. No.2772/583 of village Pouchal which was coming under alignment of Kishtwar-Sinthan Road. This was done by initially changing the status of land from “Gair Mumkin Jarh” to Gora in the year 2003 and subsequently attested mutations of the said land in favour of the beneficiaries in the year 2010 by showing their possession over the same since the year 1971. Even the possession of Shri Kuljeet Singh and Shri Pardeep Singh has been shown since 1971 whereas their dates of birth have been found as 02.02.1977 and 05.04.1964 respectively, besides the status of the land has been found as Jarh on spot which shows that mutations have been prepared fraudulently to confer undue benefit upon the beneficiaries and themselves. The verification has also found that the said land had come under alignment of Kishtwar-Sinthan road and the revenue officials in connivance with beneficiaries intended to grab compensation which was assessed by the authority in respect of the said land. During the investigation on the basis of evidence oral and documentary collected in the case the allegations leveled against the accused revenue officials and beneficiaries have been proved. After completing of the investigation the case was processed for obtaining approval from the competent authority and after obtaining the approval, Challan of the case has been produced against the above named accused public servants/beneficiaries in the concerned competent trial court for judicial determination, Next date of hearing in the case has been fixed for 24.09.2018
