Appeals all sections to show determination till vicious plans get frustrated
Srinagar: Jama’at-e-Islami Jammu and Kashmir shall support the public movement going on for the protection of Article 35(A) of the Indian constitution which the government of India has incorporated in the constitution to ensure the protection of various fundamental rights of the people of Jammu and Kashmir, in particular its demography till the people decide their political future in accordance with their aspirations as guaranteed to them through various resolutions of the security council of the United Nations Organization to which both the neighboring countries India and Pakistan have agreed in the same forum. This is a type of a covenant between the permanent residents of Jammu and Kashmir and the government of India till the right of self-determination is provided to the people here. So this is not any status of temporary nature which has been given to the people of Jammu and Kashmir but the result of the promises made to them by the government of India through the UN resolutions. And unless and until the resolutions are implemented, this Article 35(A) and Article 370 cannot be changed, altered, amended, revoked or abrogated. The abrogation of these articles legally means severance of all ties between the people of Jammu and Kashmir and the government of India and constitutionally India shall there by lose its right to occupy Jammu and Kashmir. The accession of J&K with India is conditional and subject to the result of the exercise of the right of self-determination by the people of J&K as guaranteed to them through the UN resolutions. The people permanently residing in J&K have to decide their political future that is why these two articles stand incorporated in the constitution of India! If the people living outside J&K are allowed to become permanent residents here, that will deprive the natives of this state of their right to decide their political future. The citizens of India and Pakistan have no right or authority to decide the political future of J&K but the people of state have this right and authority. Besides this fundamental right, many other economic rights will get trampled by abrogation of this Article 35(A).
Jama’at-e-Islami Jammu and Kashmir extends its full support to the public movement started for the protection of Article 35(A) which stands challenged in the Supreme Court of India by some disgruntled communalist elements with tacit backing of Hindutva brigade of India whose main object is to change the demography of Jammu and Kashmir in order to fulfill their nefarious designs. Jama’at appeals all sections of people of J&K to remain united for this cause and show determination and steadfastness till these vicious plans get frustrated.

سرینگر//جماعت اسلامی جموں وکشمیر ہندوستانی آئین میں درج آرٹیکل 35Aجس کے تحت ریاست جموں وکشمیر کے باشندوں کو خصوصی اختیارات حاصل ہونے کے علاوہ یہ بات واضح طور پردرج ہے کہ ریاست جموں وکشمیر کا بھارت کے ساتھ الحاق عارضی اور مشروط ہے، کی حفاظت کی خاطر شروع کی گئی عوامی تحریک کی مکمل حمایت کرتی ہے۔ ہندوستان اور پاکستان نے ریاستی عوام سے یہ وعدہ کیا ہے کہ ان کو اپنی سیاسی تقدیر کا فیصلہ سیکورٹی کونسل میں درج قراردادوں کے عین مطابق کرنے دیا جائے گا۔آرٹیکل 35A یہاں کے باشندوں کو اپنی رائے کا آزادانہ موقع فراہم کرنے تک ریاستی عوام اور بھارت کے درمیان ایک مشروط معاہدہ ہے۔ جب تک لوگوں کو ان کا بنیادی حق حق خودارادیت نہیں دیا جاتا تب تک آرٹیکل 35Aاور 370کو نہ تبدیل کیا جاسکتا ہے اور نہ ہی اس میں کسی قسم کی ترمیم کی جاسکتی ہے اور نہ ہی اس کو منسوخ کیا جاسکتا ہے کیوں کہ اس کی منسوخی کا قانونی مطلب یہ ہوگا کہ ریاست اور ہندوستان کے درمیان عارضی رشتہ بھی ختم ہوگا اور ہندوستان کو یہاں پھر آئینی طور پر رہنے کا کوئی حق نہیں ہے۔ حق خود ارادیت کا وعدہ جموںوکشمیر میں رہنے والے لوگوں سے کیا گیا ہے اور اگر ریاست سے باہر لوگوں کو یہاں آنے دیا جائے تو یہاں کے باشندوں کا یہ حق متاثر ہوئے بغیر نہیں رہ سکتا کیوں کہ جموں وکشمیر کے سیاسی مستقبل کا فیصلہ کرنے کا اختیار نہ ہندوستان کے شہریوں کو ہے اور نہ ہی پاکستانیوں کو، بلکہ یہ اختیار صرف اور صرف ریاست کے پشتنی باشندوں کو حاصل ہے اور دفعہ 35Aکی منسوخی سے یہاں کے عوام کے اقتصادی اور معاشی حقوق پر بھی کاری ضرب پڑنے کا قومی امکان ہے۔
جماعت اسلامی جموں وکشمیر چند عناد پسند فرقہ پرست قوتوں کی طرف سے بھارتی سپریم کورٹ میں 35Aکی منسوخی کے لیے دائر کی گئی عرضی کادفاع کرنے کی خاطر جاری عوامی تحریک کی مکمل حمایت کرتی ہے اور سماج سے وابستہ تمام طبقوں سے اپیل کرتی ہے کہ اس موقعہ پر مکمل اتحاد کا مظاہرہ کریں اور ان مذموم منصوبوں کی ناکامی تک ثابت قدمی اور محکم ارادوں کامظاہرہ کریں۔
